CHICAGO – An estate independent administrator is suing a South Elgin nursing care facility over allegations it failed to provide adequate assistance and supervision in the care and treatment services of her decedent.
Patricia White, as independent administrator for the estate of Diane Hines, filed a complaint on April 14 in the Cook County Circuit Court against Petersen Health Properties LLC alleging that the nursing care facility knowingly violated the Illinois Nursing Home Care Act.
According to the complaint, the plaintiff alleges that between Nov. 14, 2013, and April 9, 2014, Hines was re-admitted to the defendant's facility and developed a stage II pressure sore to her coccyx, severe respiratory distress and pneumonia that led to her death on April 16, 2014. The plaintiff holds Petersen Health Properties LLC responsible because the defendant allegedly failed to properly assess her decedent's condition and failure in treatment administration to prevent infection and deterioration.
The plaintiff requests a trial by jury and seeks an amount in excess of the court's jurisdictional limits plus costs of suit. She is represented by Jeffrey Schlapp of Schlapp Law Group LLC in Chicago.
