Patient accuses health service providers of negligent surgery

CHICAGO — A patient is suing a Chicago hospital and a doctor, alleging negligent treatment. 


Damian Winiarski filed a lawsuit April 15, in Cook County Circuit Court against Advocate Illinois Masonic Medical Center and Dr. John Song, alleging negligence in failing to exercise the standard care in medical care and treatment.

According to the complaint, on Aug. 6, 2012, Winiarski suffered permanent injuries of of both a personal and pecuniary nature resulting from a botched medical procedure. The plaintiff alleges the defendants used inappropriate surgical technique during a second surgery following a cervical decompression and fusion on July 30, 2012.

Winiarsk seeks a trial by jury and damages of more than $50,000. He is represented by attorney Bradley Z. Schulman of Motherway & Napleton LLP in Chicago.
