Wrongful death suit filed against Sunrise of Bloomingdale

CHICAGO – An estate independent executor has filed suit against a nursing care facility over allegations her decedent was not protected from falls.

Debbie Stein, as independent executor of the estate of Lois Buenger, filed a complaint on April 14 in the Cook County Circuit Court against SZR Bloomingdale Assisted Living LLC, doing business as Sunrise of Bloomingdale, Komal Swadas, Jennifer Torreon and Wendi Phillips alleging that they knowingly violated the Illinois Nursing Home Care Act by failing to provide assistance and supervision in the care and treatment services.

According to the complaint, the plaintiff alleges that Buenger was a resident at Sunrise of Bloomingdale from May 14, 2015, to June 3, 2015. The suit states Buenger suffered a hemorrhagic contusion and left-sided scalp laceration as a result of numerous falls and her condition deteriorated to cause her death on June 10, 2015. The plaintiff holds the defendants responsible because they allegedly failed to adequately assist and supervise Buenger to prevent her from falling and failed to properly assess and prevent the deterioration of Buenger's condition.

The plaintiff requests a trial by jury and seeks an amount of more than $50,000. She is represented by Kelly A. Sabo of Law Offices of Steven J. Malman & Associates PC in Chicago.
