Daughter blames Arlington Heights care facility for mother's injuries

CHICAGO — A daughter is suing an Arlington Heights long-time care facility, alleging its negligence caused her mother to fall and sustain injuries.

Joyce Anderson, as daughter of Tsuyaka Oda, filed a lawsuit April 20, in Cook County Circuit Court against The Lutheran Home, Cherished Place Inc., Lutheran Foundation For The Aged Inc., Lutheran Home And Services For The Aged, Inc., Lutheran Home For The Aged Inc. and Lutheran Life Communities, alleging negligence in failing to exercise due care and caution in their care and treatment services.

According to the complaint, on May 1, 2015, Oda, a stroke patient, fell to the ground while attempting to use the bathroom, causing her to suffer severe and permanent injuries. The plaintiff alleges holds failed to provide adequate assistance and supervision to prevent Oda from falling.

Andeson seeks a trial by jury, damages in excess of the court's jurisdictional limits, plus the costs of suit. She is represented by attorneys James A. McCarron and Mark Novak of Anesi, Ozmon, Rodin, Novak & Kohen LTD in Chicago.
