Family blames long-term care facility for relative's death

CHICAGO — An estate executor is suing a La Grange Park long-term care facility, alleging negligence caused a relative's death.

Joseph Chmielik, as independent executor for the estate of Stella Chmielik, filed a complaint April 20 in Cook County Circuit Court against The Grove Of La Grange Park LLC, alleging violation of the Illinois Nursing Home Care Act by failing to exercise reasonable care in providing custodial services.

According to the complaint, on Jan. 28, 2015, Stella Chmielik fell to the ground and sustained injuries that caused the deterioration of her overall condition until her death April 30, 2015. The plaintiff alleges the defendant failed to adequately provide assistance and supervision and take appropriate measures to prevent Chmielik from falling.

Joseph Chmielik seeks a trial by jury, damages of more than $50,000, plus attorney fees and costs of suit. He is represented by attorney Robert J. Rooth of The Rooth Law Firm in Evanston.
