Condo owner blames fitness center, real estate developer for unwanted noise

CHICAGO — A Chicago condo unit owner is suing a fitness center and real estate developer, alleging they failed to stop unwanted noise that caused the plaintiff to lose sleep.

Lakeview Fitness LLC and Marathon Center, Inc., a fitness center, real estate developer, citing alleged negligence.

Kristopher M. Lopez filed a lawsuit April 26 in Cook County Circuit Court against Lakeview Fitness LLC and Marathon Center Inc., alleging they failed to stop the transmission of sounds from its premises to his condominium unit.

According to the complaint, Lopez has sustained emotional and physical damages due to the lost hours of sleep caused by an obnoxious noise that reaches his condo at 3224-28 N. Halsted St., Chicago. The plaintiff alleges the defendants failed to address his request to stop the obnoxious noise from entering his condominium unit by securing an acoustical engineer to prevent the nuisance.

Lopez seeks a trial by jury and damages of more than $30,000. He is represented by attorney Keil M. Larson of Chicago.
