CHICAGO – A Woodstock farmer has filed suit against a neighboring farm alleging that it failed to exercise reasonable care and caution in using a pesticide.
Derek Burseth filed a complaint on April 25 in Cook County Circuit Court against John Knoll, Jane M. Knoll, The John H. Knoll Trust, The Jane M. Knoll Trust, Knoll's Apple Orchard & Vegetable Farm, Kevin Knoll and E.I. DuPont De Nemours & Co., alleging negligence and failure to warn.
According to the complaint, the plaintiff alleges that between April 26, 2014, and May 31, 2014, he suffered damages to his health and to his animals as a result of the defendants' spraying DuPont Avaunt insecticide on the property line between the two parties. The plaintiff holds the defendants responsible because the defendants allegedly failed to properly train and supervise its agent and/or employees as to the proper use of insecticide and failed to place signs and warnings of the unsafe and dangerous area.
The plaintiff requests a trial by jury and seeks an amount of more than $50,000 plus the costs of suit. He is represented by James A. Karamanis and Kenneth A. Nazarian of Barney & Karamanis LLP in Chicago.
