Mother blames medical providers for newborn's injuries

Medical malpractice 03

CHICAGO — A mother is suing an Arlington Heights hospital and health care providers, alleging insufficient measures were taken to secure the well-being of her newborn son.

Mary Betz, as mother and next best friend of Jake Betz, a minor, filed a lawsuit May 3, in Cook County Circuit Court against Northwest Community Hospital, Dr. Carl D. Cucco, Dr. Claudine M. Kasinak, Kathleen Gelman and Womancare PC, alleging negligence and failure to exercise proper care during the delivery of her son.

According to the complaint, her son was born Oct. 17, 2003, and suffered a fracture in his clavicle during birth at Northwest Community. The plaintiff alleges the defendants failed to recommend a cesarean section to Mary Betz, knowing that normal delivery could cause injuries to her child.

Mary Betz seeks damages of more than $50,000 from each defendant. She is represented by attorney David Nemeroff of Nemeroff Law Offices LTD in Chicago.
