Patient accuses dentist of negligence in failed tooth extraction

CHICAGO — A patient is suing a Cook County dentist, alleging failure to perform a tooth extraction.

Walberto Bautista filed a lawsuit March 16 Cook County Circuit Court against Hugh Marchmont-Robinson DDS SC., alleging negligence in failing to perform an extraction.

According to the complaint, on Aug. 28, 2008, Bautista sustained personal injuries when his lingual nerve was hit during an extraction performed by Mrachmont-Robinson and his staff. The plaintiff alleges the defendant failed to properly train its employees, which resulted in a failed tooth extraction.

Bautista seeks damages of at least $50,000, plus all legal fees. He is represented by attorney John S. Muir of Muir Law Offices in Chicago.
