Patient accuses Mercy Hosptial of negligent knee surgery

CHICAGO — A patient is suing Chicago health providers, alleging negligence in failing to properly assess the plaintiff's condition.

Rita Grassano filed a lawsuit May 4 in Cook County Circuit Court against Dr. Dirk D. Nelson, Mercy Hospital and Medical Center in Chicago, and Midland Orthopedic Associates SC, alleging negligence and breach of duty because insufficient measures were taken to prevent injuries.

According to the complaint, on May 5, 2014, Grassano underwent knee surgery. The suit says she learned Dec. 10, 2014, that she had sustained further injuries to her knee and had to undergo a revision right knee arthroplasty March 12, 2015, because the defendants failed to properly assess her condition and failed to provide properly sized knee components, which caused further harm and suffering.

Grassano seeks judgment of more than $50,000, plus all legal fees. She is represented by attorney Carl S. Salvato of Salvato & O'Toole in Chicago.
