Family accuses suing long term care facilities of wrongful death

CHICAGO — An estate administrator is suing a Chicago long term care facility, alleging its negligence caused a relative's death.

James Stewart, as independent administrator of the estate of Mattie Stewart, filed a lawsuit April 22 in Cook County Circuit Court against Belhaven Nursing and Rehabilitation Center LLC and Infinity Healthcare Management of Illinois LLC, alleging negligence and wrongful death in failing to protect Mattie Stewart from abuse and/or neglect.

According to the complaint, between June 13, 2012 and May 3, 2014, decedent Mattie Stewart resided at Belhaven facility due to high risk of skin breakdowns, dehydration and urinary track infections. On May 3, 2014, the suit says, she was transferred to Metrosouth Medical Center where she was diagnosed with severe dehydration, acute renal failure and sepsis form urinary track infection. 

Despite extensive treatment, the lawsuit states, her condition continued to decline and she died June 10, 2014. 

James Stewart alleges the defendants failed to monitor significant changes in Matie Stewart's condition, failed to provide necessary care and services, failed to develop an up-to-date care plan, failed to ensure she received proper daily personal hygiene, failed to provide restorative and rehabilitative measures, failed to objectively asses and evaluate her worsening condition and failed to provide necessary treatment and services.

James Stewart seeks a trial by jury, judgment in excess of the court's jurisdictional amount, attorney fees and costs of this suit. He is represented by attorney Jonathan W. Young of Kralovec, Jambois & Schwartz in Chicago.
