Motorist blames another driver for causing fatal crash

CHICAGO — A motorist is suing another driver, alleging the defendant's negligence caused a crash that ultimately killed the plaintiff's wife. 

James V. Pieniazek, individually and representing the estate of Patricia Pieniazek, filed a lawsuit May 10 in Cook County Circuit Court against Joshua George Kesner, alleging negligence in failing to properly control the car that caused the crash.

According to the complaint, on Dec. 7, 2005, at the intersection of 75th Street and Woodward Street in Woodridge, Kesner's Chevy truck ran into the plaintiff's Chevy Impala, causing injuries and, ultimately, resulting in the death of Patricia Pienazek on Jan. 15, 2013. 

The plaintiff alleges Kesner failed to properly control his speed and failed to keep a proper lookout.

James Pieniazek seeks a trial by jury and judgment in a sum in excess of jurisdictional limits. He is represented by attorney John R. Wienold of John R. Wienold and Associates Ltd. in Aurora.
