Patient accuses hip implant manufactures of negligence

CHICAGO — A patient is suing the manufacturers of implants, alleging a defective hip implant caused him pain and the need for a second operation.

Charles Duncan filed a lawsuit May 23 in Cook County Circuit Court against Depuy Orthopaedics Inc. and Premier Orthopaedic Sales Inc., alleging product liability in manufacturing defective implants.

According to the complaint, between June 17, 2013, and Nov. 26, 2014, Duncan suffered severe medical problems and pain due to a defective hip implant. This required a second surgery to remove the defective implant Nov. 26, the suit says. 

The plaintiff alleges the defendants manufactured and promoted defective implants containing substandard components that caused complications to Duncan's health.

Duncan seeks trial by jury, damages of more than $50,000, plus interest and court costs. He is represented by attorney Michael J. Cox of Goldberg & Goldberg in Chicago.
