Couple accuses health care providers of negligence in husband's care

Medical malpractice 04

CHICAGO – A couple is suing several medical providers alleging that insufficient measures were taken to prevent injuries.

Eugene Schmittgens and Mary Schmittgens filed a complaint on May 16 in the Cook County Circuit Court against Advocate Health and Hospitals Corp. doing business as Advocate South Suburban Hospital; Franciscan Alliance Inc.; Dr. Rao Uppuluri S.C., doing business as Chicago South Suburban Urology; Dr. and Grant Chavin, citing negligence.

According to the complaint, the plaintiffs allege that on May 27, 2014, Eugene Schmittgens suffered severed body injuries and developed serious medical conditions as a result of the defendants' negligence. The plaintiffs hold the defendants responsible because the defendants allegedly failed to provide the most-effective surgical approach to remove the adrenal mass from plaintiff Eugene Schmittgens and failed to exercise proper professional care while doing so.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount of more than $50,000 plus interest and court costs. They are represented by Ken M. Lucaccioni of Kent M. Lucaccioni LTD in Chicago.
