CHICAGO — A father is suing the city of Chicago and a city employee alleging their excessive force caused his son's death.
Eugene McSwain Sr., independent administrator of the estate of Eugene McSwain Jr., filed a lawsuit June 6 in Cook County Circuit Court against the city of Chicago and police officer Gary S. Bush, alleging excessive force, violation of civil rights and violation of human rights.when detaining McSwain Jr.
According to the complaint, on July 10, 2015, McSwain Jr. was shot in the back of the head and killed while he was being detained along with the driver of their vehicle at 106th Street and South Cottage Grove Avenue in Chicago. The plaintiff alleges Bush shot McSwain Jr. despite his son being not armed, or posing a threat to the defendant or any civilian.
McSwain Sr. seeks a trial by jury and judgment in excess of the jurisdictional limit of the court. He is represented by attorney James Montgomery Jr. of Montgomery Law Firm LLC in Chicago.
