Wrongful death suit filed against Asta Care Center

CHICAGO – An administrator has filed suit against the owners of an Elgin long-term care facility alleging that insufficient measures were taken to prevent injuries and negligence.

Brenda J. Pearson, as administrator of the estate of William Kahle filed a complaint on May 23 in the Cook County Circuit Court against Asta Care Center of Elgin LLC, Asta Healthcare Co. Inc. and Warren Park Health and Living Center LLC alleging negligence and wrongful death.

According to the complaint, the plaintiff alleges that Kahle suffered physical injuries, deterioration of his health due to malnutrition and was sometimes found to be ingesting harmful substances, which contributed or resulted in his death in July 2014. The plaintiff holds Asta Care Center of Elgin LLC, Asta Healthcare Co. Inc. and Warren Park Health and Living Center LLC responsible because the defendants allegedly failed to provide proper attention and care to Kahle while he was admitted in their facility despite being aware that he was not mentally capable of taking care of himself.

The plaintiff seeks judgment against the defendants in an amount of more than $50,000. She is represented by Cari F. Silverman and Michelle Wesley of Levin & Perconti in Chicago.
