Child, mother allege injuries from negligent care of meningitis

CHICAGO – A minor child and his mother have filed suit against a hospital and its affiliates alleging the child was permanently injured after an infection wasn't immediately diagnosed.

Henry Kobernik-Pollack, a minor, by his mother and next friend Liza Kobernik, filed a complaint on March 24 in Cook County Circuit Court against the defendants alleging that they failed to provide proper medical care.

According to the complaint, in May 2008 Kobernik-Pollack was admitted to Advocate Lutheran General Hospital experiencing a high fever and vomiting. The suit states he was tested for a urinary tract infection and the results came back negative. The plaintiff holds the defendants responsible because the defendants allegedly failed to properly evaluate Kobernik-Pollack's condition as bacterial meningitis, causing him permanent injuries including neurological damage and hearing loss.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount of more than $50,000 plus court costs. They are represented by David S.
