Wrongful-death suit says facility failed to prevent assault

CHICAGO — An independent administrator of a deceased man's estate has filed a wrongful-death suit against Courtyard Healthcare Center, LLC, d/b/a Courtyard Healthcare Center: Premier Healthcare Management, LLC; David Cheplowitz; Barak Baver; Caroline Hamilton; and Reynold Gavin a/k/a Gavin Reynolds, a long-term nursing care facility and people associated with it, alleging that the decedent was not properly protected against an assault by Gavin, a fellow resident.

Lillie Sharkey as independent administrator of the estate of Joe Adams, filed a complaint on June 17 in Cook County Circuit Court against the defendants, alleging that they failed to provide proper care and supervision to Adams.

According to the complaint, the plaintiff alleges that on June 23, 2014, Adams was physically assaulted by Gavin, which caused several severe injuries, including subdural hematoma, which contributed to or caused his death. The plaintiff holds the defendants responsible because the defendants allegedly failed to properly supervise Adams while he was being taken care of in their facility, which resulted in him being physically assaulted by another resident.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $50,000. She is represented by Marc S. Weissman of Law Offices of Steven J. Malman & Associates, P.C. in Chicago.
