Wrongful-death suit says nursing care inadequate

CHICAGO — Executors of a deceased man's estate have filed a wrongful-death suit against Rest Haven Illiana Christian Convalescent Home, Victorian Village Health and Wellness Center, and Rest Haven Illiana Christian Convalescent Home d/b/a Victorian Village Health and Wellness Center, alleging negligence and insufficient measures taken to prevent injuries in a nursing care facility.

Robert Croce, Rick Croce and Julieann Mansch, as independent executors of the estate of Samuel Croce, filed a complaint on June 15 in Cook County Circuit Court against the defendants, alleging that they failed to provide proper care to Samuel Croce.

According to the complaint, the plaintiffs allege that Samuel Croce sustained personal injuries that caused him pain and contributed to or resulted in his death. The plaintiffs hold the defendants responsible because they allegedly failed to provide adequate supervision at all times to Samuel Croce during his stay at their facility and failed to provide proper medical evaluation to Samuel after he fell from his wheelchair.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount in excess of $50,000 plus court costs and any further relief the court grants. They are represented by Steven J. Seidman and Melanie K. Fairman of Seidman Margulis & Fairman, LLP in Chicago.
