Nursing home sued in resident's death

CHICAGO — An administrator of a deceased woman's estate is suing Lexington Health Care Center of Elmhurst Inc., and Royal Management Corp., alleging that negligence in a nursing home led to injury and death.

Marilyn Rufo, special administrator of the estate of Carmello Rufo, filed a complaint on June 27 in Cook County Circuit Court against the defendants, alleging that they failed to provide proper care to Carmello Rufo while she was staying at their facility.

According to the complaint, the plaintiff alleges that due to a failure to provide appropriate help during a wheelchair transfer on March 14, Carmello Rufo fell, which contributed to or caused her death on April 2. The plaintiff holds the defendants responsible because they allegedly failed to provide adequate supervision to Carmello Rufo or to properly evaluate her overall condition after the fall.

The plaintiff seeks judgment against the defendants in an amount in excess of $50,000. She is represented by Susan E. Loggans of Susan E. Loggans & Associates, P.C. in Chicago.
