Patient claims hip implant was defective

CHICAGO — A patient is suing Depuy Orthopaedics, Inc., and Premier Orthopaedic Sales, Inc., citing alleged design defect, failure to warn, negligent misrepresentation and product liability.

Jill Bailey filed a complaint on June 29 in Cook County Circuit Court against the defendants, alleging that they manufactured a defective hip prosthesis.

According to the complaint, the plaintiff alleges that between 2009 and 2016, she suffered damages from being implanted with a defective hip prosthesis that caused high concentrations of metallic elements in her blood prompting her surgeon to remove the implant to replace it with another. The plaintiffs holds the defendants responsible for allegedly manufacturing and distributing the defective implant despite knowing the potential harmful effects it could cause.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount in excess of the jurisdictional limits of this court including interest and court costs. She is represented by Peter J. Flowers of Meyers & Flowers, LLC in Chicago.
