Utility seeks compensation for downed poles, wires

Law money 07

CHICAGO — An electric utility is suing truck driver Jaroslaw Koleczek individually and as agent of Composites One LLC, alleging negligence in the collapse of power poles and wires.

Commonwealth Edison Company filed a complaint on July 6 in Cook County Circuit Court against the defendants, alleging that Composites One employee Koleczek was driving a company truck when he caused significant damage to overhead wires and poles owned by the plaintiff.

According to the complaint, the plaintiff alleges that on Jan. 27, 2015, Commonwealth Edison Company sustained damages to its property when a tractor trailer caught one of the wires, bringing down the poles and wires. The plaintiff holds the defendants responsible because Koleczek allegedly failed to verify the appropriate clearance while operating the vehicle.

The plaintiff seeks judgment against the defendants in an amount of $43,084.90 plus court costs. It is represented by Larry S. Kowalczyk of Querrey & Harrow, Ltd. in Chicago.
