Representative of estate claims $391K from real estate deal was loan that should be repaid

CHICAGO — A deceased man's family is suing another man, saying he owes them a debt of nearly $392,000 from a real estate deal. 

Debra E. Weese-Mayer, as independent executor of the estate of Robert N. Mayer, and as trustee of the Robert N. Mayer Trust, filed a complaint on Sept. 9 in Cook County Circuit Court against Harry A.  Phinney, alleging that the defendant failed to settle a debt with the trust.

According to the complaint, the plaintiff alleges that she suffered monetary damages from the unpaid amount. The plaintiff holds Phinney responsible because the defendant allegedly refused to pay his share of a loan according to an agreement.

The plaintiff seeks judgment against the defendant in the amount of $391,500 plus any further relief the court grants. She is represented by Richard D. Boonstra of Hoogendoorn & Talbot LLP in Chicago.
