Buyers sue home seller, alleging failure to inform of defects

CHICAGO — Two buyers are suing a property seller, alleging breach of contract, breach of implied warranty and fraud.

Joseph Hinker and Dina Pecoraro filed a complaint on Sept. 9 in Cook County Circuit Court against John Atkin, alleging that the property owner failed to inform the plaintiffs about defects in a property.

According to the complaint, the plaintiffs allege that in 2015, they suffered damages from being misled into buying a home that had several defects, including water leaks, mold and water damage. The plaintiffs holds Atkin responsible because the defendant allegedly had knowledge of the defects in the property but failed to disclose this information with the buyers.

The plaintiffs seek judgment against the defendant for damages sufficient to compensate them for the repair of these items, court costs and any further relief the court grants. They are represented by Vincent R. Vidmer of The Law Office of Vincent R. Vidmer in Chicago.
