Laborer claims Del Monte Fresh Produce, others responsible for injuries

CHICAGO — A former laborer for a staffing service is suing Del Monte Fresh Produce N.A. Inc., Ashley Calumet LLC and Ashley Capital LLC, alleging negligence, liability and insufficient measures taken to prevent injuries.

Francisco Palacios filed a complaint on Oct. 28, in Cook County Circuit Court against the defendants, alleging that they failed to provide the plaintiff a safe place to work.

According to the complaint, the plaintiff alleges that on Dec. 18, 2014, he sustained physical injuries when he fell from a raised scaffolding while cleaning the Del Monte facility. The plaintiff holds the defendants responsible for allegedly failing to provide safety equipment to the plaintiff or to properly inspect the work area.

The plaintiff seeks judgment against the defendants in an amount greater than $50,000 plus court costs. He is represented by Colin J. O'Malley of Goldberg Weisman Cairo in Chicago.
