CHICAGO – A woman's representative alleges a North Aurora long-term care facility did not protect a resident from falls.
Diane Smith as attorney in fact for Consuelo Guerra filed a complaint on Oct. 31 in Cook County Circuit Court against Asbury Pavilion Nursing & Rehabilitation Center LLC, doing business as Asbury Gardens Nursing & Rehabilitation; Asbury Healthcare LLC; and a nurse, alleging that they failed to provide proper care to Consuelo Guerra.
According to the complaint, Guerra was a resident of the defendants' facility from Aug. 31, 2015, to Nov. 6, 2015, and was at high risk for falls. The plaintiff alleges Guerra fell while under the defendants' care on at least five occasions from Aug. 24, 2015, to Oct. 13, 2015.
The plaintiff holds Asbury Pavilion Nursing responsible because the defendants allegedly failed to provide necessary care or services to Guerra or provide adequate supervision to her at all times.
The plaintiff seeks judgment against the defendant in an amount greater than $50,000. She is represented by Michael F. Bonamarte and Ashley Hadler Herschberger of Levin & Perconti in Chicago.
