CHICAGO — The owners of a convenience store are suing a neighboring cleaners shop, citing alleged negligence, after the owners of the neighboring shop tried to fight a fire themselves instead of calling the fire department, resulting in damage to the building.
Drake Quick Mart, Inc. filed a complaint on Nov. 1 in Cook County Circuit Court against Jear Enterprises Corporation, which does business as Irving Plaza Cleaners, alleging that the defendant failed to call the fire department upon learning of a fire that originated in the back room of its store, adjacent to the plaintiff's business.
According to the complaint, the plaintiff alleges that in October 2015, Drake Quick Mart Inc. suffered fire damage to its property. The plaintiff holds Jear Enterprises responsible because the defendant allegedly attempted to put out the fire instead of alerting tenants or calling the appropriate authorities.
The plaintiff seeks judgment against the defendant in an amount greater than $50,000 plus court costs. It is represented by Gary D. Ashman and Richard M. Jacobson of Ashman & Stein in Chicago.
