Family alleges Bella Terra Morton Grove did not prevent resident's fall

CHICAGO – A woman's family has accused a Morton Grove long-term care facility of not providing proper care to prevent falls.

Davor Engel, as independent administrator of the estate of Dusan Engel, filed a complaint on Nov. 23 in Cook County Circuit Court against Morton Grove Living & Rehab Center LLC, doing business as Bella Terra Morton Grove and Bethany Terrace Nursing Centre, Legacy Healthcare Financial Services LLC alleging negligence.

According to the complaint, the plaintiff alleges that Dusan Engel experienced an unwitnessed fall in his room that contributed to the deterioration of his health while in the defendants' care. The plaintiff holds the defendants  responsible because the defendants allegedly failed to provide adequate supervision to Dusan Engel to address her risk of falling.

The plaintiff seeks judgment against the defendants in an amount of more than $50,000. He is represented by Michael F. Bonamarte and W. Kent Winingham of Levin & Perconti in Chicago.
