CHICAGO — A patient and her husband are suing Community Health NFP, Rachel Klamo, D.O., and Wal-Mart Stores Inc., alleging negligence, loss of consortium and violation of the Illinois Pharmacy Practice Act.

Zoileny Santos Reynoso and Carlos Valdez filed a complaint on Dec. 29 in Cook County Circuit Court against the defendants, alleging damages in connection with the prescribing of the drug Lamotrigine.

According to the complaint, the plaintiffs allege Santos Reynoso suffered from the development of rashes on her back and arms and a diagnosis of toxic epidural necrosis, which they purport was a side effect of improperly prescribed Lamotrigine. The plaintiffs hold the defendants responsible for allegedly prescribing and dispensing the drug despite their claim that the prescription dosage was contrary to the manufacturer's recommendation.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount greater than $50,000. They are represented by Edward W. McNabola of McNabola & Associates, LLC in Chicago.
