Patient alleges ERIEM Surgical Inc.'s device caused thermal damage during surgery

Medical malpractice 04

CHICAGO – A Chicago woman alleges she was injured by a medical device during a surgery.

Jennifer Marie Zizumbo filed a complaint on Jan. 6 in Cook County Circuit Court against ERIEM Surgical Inc. and Little Co. of Mary Hospital and Health Care Centers alleging negligence and design defect.

According to the complaint, the plaintiff alleges she suffered thermal damage to her breast during a surgical procedure at Little Co. of Mary Hospital. She blamed the injuries on the use of ERIEM's MICRINS Fiber-Optic Breast Retractor.  The plaintiff holds ERIEM Surgical Inc. and Little Co. of Mary Hospital and Health Care Centers responsible because the defendants allegedly opted to use the device on plaintiff despite it not being properly tested.

The plaintiff seeks judgment against the defendant in an amount of more than $50,000, plus court costs and any further relief the court grants. She is represented by James A. Karamanis and Jennifer Timm of Barney & Karamanis, LLP in Chicago.
