Alden Town Manor failed to protect dementia patient from sexual assault, complaint states

CHICAGO — A woman is suing a nursing facility, alleging that insufficient measures were taken to prevent a patient who suffers from dementia from being sexually assaulted.

Jane Doe, as guardian of the estate of a woman suffering from dementia, filed a complaint on Feb. 8 in the Cook County Circuit Court against Alden-Town Manor Rehabilitation and Health Care Center, Inc., Alden Town Manor and an Alden employee, alleging they failed to provide proper care to the woman.

According to the complaint, the plaintiff alleges that the woman sustained physical and emotional damages from being sexually assaulted at the nursing facility. The plaintiff holds the defendants responsible because they allegedly failed to provide adequate supervision to prevent the woman from being sexually abused.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount greater than $50,000. She is represented by Michael T. Mertz and Brian J. Holmes of Hurley, McKenna & Mertz P.C. in Chicago.
