Couple alleges doctor, Mercy Health System, Advocate failed to properly diagnose wife's cancer

CHICAGO — A husband and wife are suing Mercy Health, Advocate Health and a doctor, alleging they were negligent in a late diagnosis of cancer.

Parul Upadhyay and Jignesh Upadhyay filed a complaint on Feb. 16 in Cook County Circuit Court against Dr. Raja Chatteriji, Mercy Health System Corporation, Advocate Health Partners and Advocate Physician Partners, alleging they failed to provide proper medical care to Parul Upadhyay.

According to the complaint, the plaintiffs allege Upadhyay was diagnosed with breast cancer and ovarian cancer, but was initially told that her test results were negative, making her physical condition more serious. The plaintiffs holds the defendants responsible because they allegedly failed to properly interpret the results from Upadhyay's BRCA test, which resulted in the late diagnosis of her cancer.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount greater than $50,000, plus court costs. They are represented by Matthew L. Williams and John A. Mennie of Salvi, Schostok & Pritchard P.C. in Waukegan.
