Mother of deceased child alleges Continuum Pediatric Nursing Services failed to monitor child's breathing

CHICAGO — The mother of a deceased child is suing a nurse and in-home care provider Continuum Pediatric Nursing Services Inc. for allegedly failing to properly monitor the child's breathing and realize his ventilator had stopped working.

Michele Sagen Pasch, the mother and administrator of the estate of her son, filed a lawsuit on March 2 in Cook County Circuit Court alleging the defendants failed to provide proper care to her son, who needed a ventilator in order to breathe.

According to the complaint, the plaintiff alleges the boy sustained irreversible and fatal brain damage due to oxygen deprivation. The plaintiff holds the defendants responsible for allegedly failing to monitor the boy's condition and call 911 when he was showing signs of oxygen deprivation.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount greater than $50,000, plus court costs. She is represented by Elizabeth A. Kaveny of Burke Wise Morrissey & Kaveny, LLC in Chicago.
