CHICAGO — An Illinois man is suing S. Reynaga Construction Company for allegedly taking insufficient measures to prevent a bollard from falling from an excavator and striking the plaintiff.

Juan Villafuerte filed a lawsuit on March 7 in Cook County Circuit Court alleging the defendant failed to make sure that a bollard the defendant was removing was properly secured to an excavator.

According to the complaint, the plaintiff alleges he sustained serious physical injuries on June 8, 2015, when the bollard fell from an excavator operated by the defendant and landed on him. The plaintiff holds the defendant responsible for allegedly failing to make sure the chain supporting the bollard was safe.

The plaintiff seeks judgment against the defendant in an amount greater than $50,000, plus court costs. He is represented by David R. Centracchio of Gordon & Centracchio L.L.C. in Chicago.
