Lockhart, Morris & Montgomery accused of misrepresentation in debt collection

CHICAGO — A man is suing Lockhart, Morris & Montgomery, a Texas business, for alleged misrepresentation in debt collection.

Matthew Diggs filed a lawsuit on March 1 in the U.S. District Court for the Northern District of Illinois alleging the defendant sent a collection letter to him that did not include the name of the debtor.

According to the complaint, the plaintiff alleges he sustained damages in February 2017 after receiving a collection letter that did not identify to whom he owed money. Diggs holds the defendant responsible for allegedly failing to provide truthful information in the letter it sent him.

The plaintiff requests a trial by jury and seeks statutory damages, court costs and any further relief the court grants. He is represented by John P. Carlin of Suburban Legal Group PC in Schaumburg.
