CHICAGO — Employees of an Applebee's location have filed a class-action lawsuit against franchisees RMH Franchise Corp., RMH Illinois LLC and RMH Franchise Holdings Inc. for allegedly not paying them for overtime work they performed.
Chamora Ivery and Noah Siebenaller filed the lawsuit on March 1 in the U.S. District Court for the Northern District of Illinois alleging the defendants failed to properly compensate them for their work.
According to the complaint, the plaintiffs allege they were not properly paid for work they performed in excess of 40 hours per week. The plaintiffs hold the defendants responsible for allegedly failing to pay them overtime wages.
The plaintiffs request a trial by jury and seek unpaid overtime pay, liquidated damages, statutory penalties, restitution, interest, injunctive relief, court costs and any further relief the court grants. They are represented by Justin M. Swartz and Melissa L. Stewart of Outten & Golden LLP in New York.
