CHICAGO — An insurance company is suing Polo Masonry Builders Inc., Jenny Builders Inc. and Antonia Lopez, special administrator of the estate of Roman Iatsyshyn, to avoid defending or compensating them after one of the defendants' employees suffered a fatal injury on the job.
Scottsdale Insurance Company filed a lawsuit on March 2 in the U.S. District Court for the Northern District of Illinois alleging the defendants failed to provide a safe working environment for their employees.
According to the complaint, the plaintiff allege the defendants failed to properly supervise the work being done on their premises, which resulted in Iatsyshyn being struck and killed by a falling cinder block.
The plaintiff seeks to declare that it has no duty to defend Polo Masonry or Jenny Builders in a case that is currently pending in Cook County Circuit Court, plus any other further relief this court grants.
