CHICAGO — A California couple is suing The SoyNut Butter Company and three unnamed individuals with the company, citing alleged negligence and product liability for selling products linked to a recent E. coli outbreak.

Lisa Leavitt-Garcia and Rolando Garcia filed a complaint on March 13 in the U.S. District Court for the Northern District of Illinois against the defendants, based in Glenview, alleging that they manufactured a defective food product that caused injuries to the plaintiffs.

According to the complaint, the plaintiffs allege that they became ill as the result of consuming a food item that was contaminated with E. coli. The plaintiffs hold the defendants responsible because they allegedly failed to make sure that their food product was safe for consumption and free from any contaminants that could cause injury.

The plaintiffs request a trial by jury and seek damages, compensation, general, special, incidental and consequential damages, court costs and any further relief as this court deems just. They are represented by Gary A. Newland of Newland & Newland LLP in Arlington Heights.
