Restaurant worker says Pita Inn, of Wheeling, failed to pay adequate wages

CHICAGO — An employee has filed a class action lawsuit against Mediterranean Kitchens Inc., which does business as Pita Inn, and Falah Tabahi, the restaurant owner, citing alleged unpaid wages, violation of applicable minimum wage law and violation of workers compensation acts.

Fidel Trujillo filed a complaint on behalf of other similarly situated employees on March 9 in the U.S. District Court for the Northern District of Illinois alleging the Wheeling restaurant failed to properly compensate the plaintiff for his work. He claims his employer paid him by check for the first 40 hours of weekly work and then would compensate him with cash at his regular hourly rate for work beyond 40 hours.

According to the complaint, the plaintiff alleges he sustained damages from not being paid minimum wage for his work. The plaintiff holds Pita Inn and Falah Tabahi responsible because the defendants allegedly failed to pay an overtime wage to the plaintiff.

The plaintiff seeks owed overtime wages, damages and any further relief this court grants. He is represented by Valentin T. Narvaez of Consumer Law Group LLC in Chicago.
