CHICAGO — A man is suing Lexington Health Care Center of Chicago Ridge Inc. and Lexington Health Care Center Inc., a nursing facility, citing alleged insufficient measures were taken to prevent injuries and negligence.
Tiburcio Guttierrez, as administrator of the estate of Elvira Gutierrez, filed a complaint on April 13 in Cook County Circuit Court against the defendants alleging they failed to provide proper care to Elvira Gutierrez.
According to the complaint, the plaintiff alleges Gutierrez experienced pain from suffering a fall which led to the deterioration of her health. The plaintiff holds the defendants responsible because they allegedly failed to provide adequate supervision to Gutierrez to address her risk of falls.
The plaintiff seeks judgment against the defendant in an amount greater than $50,000, plus court costs. He is represented by Paul G. O'Toole of Salvato & O'Toole in Chicago.
