Man claims Uber driver drove off before he had left car, causing partial thumb amputation

CHICAGO — A man is suing Rasier LLC, Uber Technologies Inc. and driver Carlos Polk, citing alleged insufficient measures were taken to prevent injuries and negligence after he suffered a hand injury while a passenger.

Miguel Martinez filed a complaint on April 17 in Cook County Circuit Court against the defendants alleging Polk, who was employed by defendants Rasier and Uber, was negligent in his actions as Martinez was exiting Polk's vehicle, leading to his injury.

According to the complaint, the plaintiff alleges that, on Feb. 4, 2017, his thumb was partly amputated by the car door of his Uber ride; the suit claims Martinez had not fully vacated the car before Polk started driving, causing the door to slam on his thumb. The plaintiff holds the defendants responsible because Polk allegedly failed to adequately look out for his passenger's safety.

The plaintiff seeks judgment against the defendants in an amount greater than $50,000 plus court costs. He is represented by David Nemeroff of Nemeroff Law Offices Ltd. in Chicago.
