CHICAGO — A consumer is suing Fifth Third Bank, citing alleged violation of telephone harassment statutes.
Christopher Valdes filed a complaint on March 27 in the U.S. District Court for the Northern District of Illinois against Fifth Third Bank alleging it called the plaintiff multiple times a day to collect an alleged debt.
According to the complaint, the plaintiff alleges that, in 2017, he sustained damages from receiving several collection calls on his cellular telephone. The plaintiff holds the defendant responsible because it allegedly used an automatic dialer to call the plaintiff to remind him of his debt, which he disputes he owes.
The plaintiff requests a trial by jury and seeks actual and punitive damages, court costs, injunction against the defendant and any further relief this court grants. He is represented by Nathan C. Volheim of Sulaiman Law Group Ltd. in Oak Brook.
