Suit says bank incorrectly reported debt to credit agencies, which failed to investigate

CHICAGO — A woman is suing Merrick Bank, Experian Information Solutions Inc., TransUnion LLC and Equifax Information Services LLC, citing alleged breach of duty for misinformation in credit reporting.

Rosemarie Camp filed a complaint on March 31 in the U.S. District Court for the Northern District of Illinois against the defendants alleging they failed to investigate plaintiff's dispute on her credit information.

According to the complaint, the plaintiff alleges she sustained damages as the result of incorrect reporting of her credit information. The plaintiff holds the defendants responsible because they allegedly failed to tag plaintiff's account as "disputed by the customer." The plaintiff claims she paid in full a debt owed to Merrick, a Utah-based bank, but that it continued reporting to the three major credit agencies that there was a balance due on the account.

The plaintiff seeks actual damages, punitive damages, court costs and any further relief this court grants. She is represented by Alexander J. Mikulaschek of the Law Offices of Robert S. Gitmeid & Assoc. PLLC in New York.
