Kresmery says Commerce and Industry Insurance failed to provide coverage for lawsuit

CHICAGO — A company is suing Commerce and Industry Insurance Company, R.R. Donnelley & Sons Company and Charles Emery, citing alleged breach of contract and breach of duty.

Kresmery Companies LLC filed a complaint on April 20 in Cook County Circuit Court against the defendants, alleging that Commerce and Industry Insurance Company failed in its duty to provide coverage for Kresmery in a lawsuit stemming from an injury that Emery says he suffered on Kresmery's property.

According to the complaint, the plaintiff alleges the insurance company allegedly breached its duty to the plaintiff by failing to help defend Kresmery from a lawsuit.

The plaintiff seeks to declare that the defendants owed a duty to defend the plaintiff they did not fulfill, as well as any further relief this court grants. It is represented by Jeffrey S. Barger of ESP Kreuzer Cores LLP in Wheaton.
