Widow sues doctor, Porteno Medical for missed diagnosis

CHICAGO — A man's family is suing Dr. Gregorio Rosenstein and Porteno Medical Services S.C., citing alleged insufficient measures were taken to prevent injuries and negligence.

Maria Avila, independent administrator of the estate of Miguel Avila, filed a complaint on April 24 in Cook County Circuit Court alleging the defendants failed to provide proper medical care to Miguel Avila.

According to the complaint, the plaintiff alleges Avila sustained serious physical injuries while under the care of Rosenstein last August, including severe cerebrovascular damage which contributed to the deterioration of his health. The plaintiff holds Rosenstein and Porteno Medical Services responsible because the defendants allegedly failed to properly assess Avila's condition and failed to tell the decedent to stop taking prescription blood thinner drug, warfarin, in his condition. Miguel Avila died Aug. 30.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount greater than $50,000 plus court costs. She is represented by Donald A. Shapiro Ltd. in Chicago.
