Suit alleges BNSF Railway failed to prevent employees' asbestosis

CHICAGO — Seven employees are suing BNSF Railway Company, alleging a hostile work environment and that insufficient measures were taken to prevent injuries.

Clarence J. Dolley, Frank M. Sedlacek, Donald R. Fowler, Antonio Garcia, Gerald J. Higgins, David E. Salvino and John H. Walker filed a complaint on May 5 in Cook County Circuit Court against BNSF Railway Company alleging their employer failed to provide a reasonably safe working environment to its employees.

According to the complaint, the plaintiffs allege they were injured from developing asbestosis, a lung disease, as a result of working for the defendant. The plaintiffs hold the company responsible because it allegedly failed to provide adequate safety equipment to its employees.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount greater than $50,000. They are represented by James T. Foley of Ridge & Downes in Chicago.
