Cook County, sheriff alleged liable for employee's early retirement

CHICAGO — A man is suing Cook County Sheriff Thomas J. Dart, Cook County and human resources administrator Wyola, alleging discrimination, retaliation and violation of the Family and Medical Leave Act (FMLA).

Salvatore Ziccarelli filed a complaint on April 27 in U.S. District Court for the Northern District of Illinois against the defendants alleging they threatened the plaintiff with discharge if he took a leave of absence.

According to the complaint, the plaintiff alleges he was forced into early retirement, fearing that his employer would take action against him for exercising his rights to FMLA. The plaintiff holds the defendants responsible because they allegedly interfered with plaintiff's FMLA-protected leave when he needed medical treatment.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount greater than $75,000, plus court costs and any further relief this court grants. He is represented by Michael J. Greco, of Chicago.
