Mother says Lurie Children's Hospital, staff were negligent in son's treatment

CHICAGO — A mother is suing Biraju Patel M.D.; Radiology Imaging Specialists Ltd.; Alyssa Volk-Choate M.D.; Haena Kim M.D.; and Ann & Robert H. Lurie Children's Hospital of Chicago, alleging negligence.

Gina Magana, as guardian of her son, filed a complaint on May 10 in Cook County Circuit Court against the defendants alleging that they failed to provide proper medical care to the boy.

According to the complaint, the plaintiff alleges the boy sustained injuries to his esophagus and vocal cords due to a swallowed battery. The plaintiff holds the defendants responsible because they allegedly failed to recognize that the object swallowed was a battery and not another, smaller foreign object.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount greater than  $50,000. She is represented by Jeffrey J. Tallis and Robert M. Warsaski of Faklis, Tallis & Mead PC in Chicago.
