LVNV Funding allegedly directly contacted woman in violation of debt collection statutes, lawsuit says

CHICAGO — A woman is suing LVNV Funding LLC, a debt collector, alleging misrepresentation in debt collection.

Shirley Crawford filed a complaint on May 2 in U.S. District Court for the Northern District of Illinois alleging the collection agency contacted the plaintiff regarding her debt despite her being represented by an attorney.

According to the complaint, the plaintiff alleges that, on May 26, 2015, she was damaged from being contacted directly by a debt collector. The plaintiff holds LVNV Funding responsible because the defendant allegedly knew the plaintiff was being represented by lawyers, through which all communication should pass, but still contacted her regarding her debt. The plaintiff was represented through the Chicago Legal Clinic's Legal Advocates for Seniors and People with Disabilities program.

The plaintiff requests a trial by jury and seeks statutory damages, court costs and any further relief this court grants. She is represented by David J. Philipps, Mary E. Philipps and Angie K. Robertson of Philipps & Philipps Ltd. in Palos Hills.
