North Star allegedly left 5-year-old student unattended

CHICAGO — A minor, through her mother, is suing North Star Child Development Inc., claiming the school left the child unattended on school grounds.

Maribel Martinez filed suit on behalf of her minor daughter on May 23 in Cook County Circuit Court against North Star Child Development alleging it failed to provide proper assistance to the child.

According to the complaint, the plaintiff alleges that, in June 2015, her five-year-old daughter was abandoned after she went to use the bathroom and the rest of the class was taken by their teacher to the gymnasium. The plaintiff holds the defendant responsible because it allegedly failed to provide adequate supervision to the child, who became distraught and left campus to walk to her grandmother's house several blocks away, causing her school and family to search for her.

The plaintiff seeks judgment against the defendant in an amount greater than $50,000 plus court costs. She is represented by David J. Gallagher of The Vrdolyak Law Group LLC in Chicago.
